IMPORTANT INFORMATION

PGN UPDATE – May 9, 2008

PGN decided to extend the initial interviews to more cases. We still have to wait for the official statement to see if all the cases will go through this interview and if it will be applied to all the files once they are resubmitted to PGN. Rumors are that will be the case, but we’ll wait until May 10th to confirm.

The first group of Birth Mothers was presented by their Attorneys, as well as the Foster Mother and child. Representatives from PGN, Central Authority, Human Rights, MP (Distrital Attorneys office), and Police were present also. The National and International Press attended as well which made things very uncomfortable.

The Attorneys in charge of the cases were the only ones authorized to be present in the interview. We talked to several of them, some mentioned that the Birth Mother was only requested to ratify her consent, explain the reason of placing her child for adoption, the date when the child was born and also verify the documents she presented (ID, BC) that correspond to her and her child, however in other cases the Birth Mothers were asked if she received any kind of incentive (money) or if she was in any way pressured to consent. In every case, PGN personal reminded the Birth Mothers their right to decide not to continue with the adoption process, but didn’t pressure them to make that decision at all.

Due to this being the first day, things are moving very slow but hopefully once they get on a routine things will start moving faster…

We will continue to pay attention to the changes at PGN and hopefully soon will be able to come up with an approximate time of how long it will take for files to be released.

Expiration times


Do not forget about checking on the expiration dates because we have known about families that were in the final stages and they find out at the end that some of the documents were already expired, that made them waste valuable time in issues that could be solved if they had that knowledge before. Please take note.

GLOSARY

PGN (Procuraduría General de la Nación): In the adoption process is the Guatemalan Government entity responsible for reviewing all the documents and procedures according
to the law. PGN approval allows the attorney to issue the Final Deed ‘Escritura Final de Adopción’.

PGN RECEIPT: PGN receipt is the document PGN issues and refers to the Notary when he submits the file. This receipt contains the file number that was assigned to your case, and the exact time and date the file was submitted.

PGN Previo/kick out: This is a resolution issued by PGN requesting the Attorney in charge of the file to add, fix or change documents that belong to the adoption file. After the attorney fulfils what was required through the preview, the file is resubmitted to PGN.

ACCREDITED ADOPTION SERVICE PROVIDERS

The US Embassy published the list of the adoption service providers that have been accredited, approved or temporarily accredited through either the Council on Accreditation (COA) or the Colorado Department of Human Services (CO).
